Acceptable Use Policy

This Acceptable Use Policy ("AUP") establishes the standards of acceptable and prohibited use of KindGive.com (the "Platform"), which is operated by Kindly Tech LTD ("we", "us", "our"). This policy applies to all users of the Platform, including Project Owners, Supporters, visitors, and any other individuals or entities that access or use our services ("Users").

By accessing or using KindGive.com, you agree to comply with this AUP and all applicable laws, rules, and regulations. We may modify this AUP at any time by posting the revised version on our Platform. Your continued use of our Platform after any changes constitutes your acceptance of the revised AUP.

The purpose of this Acceptable Use Policy is to:

1. Ensure the security, reliability, and integrity of our Platform
2. Protect the safety and privacy of our Users
3. Foster a trustworthy and respectful community environment
4. Prevent illegal, fraudulent, or harmful activities

All use of KindGive.com must be lawful, ethical, and respectful of others' rights. When using our Platform, you must:

4.1 Account Security

You are responsible for maintaining the security of your account, including:

• Choosing a strong, unique password and updating it regularly
• Not sharing your account credentials with others
• Ensuring that any device used to access your account has up-to-date security software
• Logging out of your account after each session, especially on shared devices
• Promptly notifying us if you suspect any unauthorized access to your account

4.2 Account Information

You must provide and maintain accurate, current, and complete information for your account, including:

• Your legal name and contact information
• Accurate personal or organizational details
• Valid payment information where required
• Truthful information about your identity and qualifications

4.3 Account Transfer

Accounts are non-transferable. You may not sell, trade, gift, or otherwise transfer your account to another person or entity without our express written permission.

You may not post, upload, share, or otherwise make available any content that:

1. Illegal Content
   • Content that violates any applicable law, regulation, or court order
   • Material that facilitates or promotes criminal activities
   • Content related to illegal drugs, substances, or paraphernalia
   • Material that infringes on any third party's intellectual property rights
2. Harmful or Dangerous Content
   • Content that promotes violence, terrorism, or extremism
   • Material that encourages self-harm or suicide
   • Instructions for creating weapons, explosives, or other dangerous materials
   • Content that promotes harmful health practices or misinformation
3. Hateful Content
   • Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics
   • Hate speech, slurs, or derogatory language targeting protected groups
   • Content that promotes organizations with hate-based ideologies
4. Harassing Content
   • Content that bullies, intimidates, or harasses others
   • Threats of violence or harm
   • Revealing others' private information without consent (doxxing)
   • Sexual harassment or unwanted sexual advances
5. Sexually Explicit Content
   • Pornography or sexually explicit material
   • Content that depicts or promotes sexual exploitation
   • Adult services or escort services
   • Inappropriate sexual content involving minors
6. Fraudulent Content
   • Content designed to deceive, mislead, or defraud others
   • False or misleading claims about Products, services, or causes
   • Impersonation of others, including public figures or organizations
   • Fake news or misinformation presented as fact
7. Spam and Unauthorized Promotional Content
   • Unsolicited commercial messages
   • Pyramid schemes or multi-level marketing content
   • Content that artificially inflates engagement
   • Bulk or automated content distribution

In addition to content restrictions, the following activities are prohibited on KindGive.com:

1. Illegal Activities
   • Money laundering, terrorist financing, or fraud
   • Violating sanctions or export control laws
   • Tax evasion or other financial crimes
   • Activities that violate applicable consumer protection laws
2. Fraud and Deception
   • Creating fake Projects or campaigns
   • Misrepresenting the purpose or use of funds
   • Providing false information about your identity, qualifications, or affiliations
   • Manipulating the Platform's systems or metrics
3. Security Violations
   • Attempting to gain unauthorized access to systems, accounts, or data
   • Testing or probing the vulnerability of our systems
   • Interfering with the security or functionality of the Platform
   • Introducing malware, viruses, or other harmful code
4. Spam and Unsolicited Communications
   • Sending unsolicited messages to other Users
   • Harvesting User information for marketing purposes
   • Creating fake accounts or automated systems
   • Artificial manipulation of Project visibility or rankings
5. Abuse of Reporting Systems
   • Submitting false or malicious reports
   • Using reporting systems to harass others
   • Coordinated reporting campaigns to target legitimate content
6. Circumvention
   • Attempting to circumvent Platform restrictions or suspensions
   • Using technical methods to evade content detection
   • Creating new accounts after being banned
7. Commercial Exploitation
   • Using the Platform for unauthorized commercial purposes
   • Reselling or scraping Platform content
   • Unauthorized use of Platform data

When creating Projects on KindGive.com, you must adhere to the following guidelines:

7.1 Honest Representation

• Clearly and accurately describe your Project's purpose, goals, and intended use of funds
• Provide truthful information about your identity, background, and qualifications
• Disclose any material facts that might affect a Supporter's decision to contribute
• Do not make promises or guarantees that you cannot reasonably fulfill

7.2 Financial Transparency

• Clearly state how funds will be used
• Provide regular updates to Supporters about Project progress and fund usage
• Be prepared to provide documentation of fund usage if requested
• Do not commingle Project funds with personal funds in a misleading way

7.3 Reward Fulfillment

• Only offer Rewards that you can realistically deliver
• Clearly describe Rewards, including any limitations or conditions
• Provide realistic timelines for Reward delivery
• Communicate promptly about any delays or issues with Reward fulfillment

7.4 Communication Standards

• Respond to questions and messages from Supporters in a timely manner
• Provide regular Project updates, especially if there are changes or delays
• Be transparent about challenges or setbacks
• Do not use aggressive or manipulative tactics to solicit support

All communications on KindGive.com must adhere to the following standards:

8.1 Respectful Communication

• Use respectful and professional language in all interactions
• Do not engage in personal attacks, harassment, or bullying
• Respect differences of opinion and cultural diversity
• Do not use offensive, vulgar, or discriminatory language

8.2 Project Updates

• Provide regular, honest updates about your Project's progress
• Clearly communicate any delays, challenges, or changes to your Project
• Respond to questions from Supporters in a timely manner
• Be transparent about how funds are being used

8.3 Prohibited Communications

You may not use our Platform to:

• Send unsolicited commercial messages or spam
• Harass, threaten, or intimidate other Users
• Impersonate other individuals or organizations
• Spread misinformation or false claims
• Coordinate harmful or malicious activities

9.1 Respect for Intellectual Property

You must respect the intellectual property rights of others when using our Platform:

• Do not upload, post, or share content that infringes on others' copyrights, trademarks, patents, or other intellectual property rights
• Only use content that you own, have licensed, or have permission to use
• Provide proper attribution when using others' content with permission
• Respect copyright notices and license agreements

9.2 Your Content

By posting content on our Platform, you represent and warrant that:

• You own or have the necessary rights to use and share the content
• The content does not infringe on any third party's intellectual property rights
• You have obtained appropriate releases for any recognizable individuals in your content
• You understand that we may use your content as described in our Terms of Use

9.3 Copyright Infringement Reports

We respect intellectual property rights and will respond to notices of alleged copyright infringement:

• Copyright owners can report alleged infringement using our designated process
• We will remove content that we determine infringes copyright after proper investigation
• Repeat infringers may have their accounts terminated

Kindly Tech LTD respects the intellectual property (IP) rights of others and expects our Users to do the same. We have established a process for third parties to report content they believe infringes their copyrights, trademarks, or involves counterfeit goods.

How to Submit a Report

If you are a rights holder or an authorized representative and believe that your IP rights have been infringed by content on KindGive.com, you may submit a formal report to our designated agent.

Reports must be submitted via email to our designated IP agent at: report@KindGive.com

To be effective, your notification must be in writing and include the following information (a "Notice"):

1. 1 Your Contact Information: Your full name, mailing address, telephone number, and email address.
2. 2 Identification of the IP: A detailed description of the copyrighted work, trademark, or other IP that you claim has been infringed. For trademarks, include the registration number and jurisdiction. For copyrights, identify the original work and, if applicable, registration details.
3. 3 Identification of Infringing Material:
   • The exact URL(s) (web address) where the allegedly infringing content is located on our Platform.
   • A description of the content you claim is infringing.
   • For counterfeit reports, explain why the item is not genuine or unauthorized.
4. 4 A Statement of Good Faith: A statement that you have a good faith belief that the disputed use is not authorized by the IP owner, its agent, or the law.
5. 5 A Statement of Accuracy: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the IP owner or are authorized to act on the owner's behalf.
6. 6 Signature: An electronic or physical signature of the person authorized to act on behalf of the IP owner.

What Happens After You Report

1. 1 Acknowledgement: We will acknowledge receipt of your complete report via email.
2. 2 Review: Our designated agent will review your Notice for completeness, validity, and substantive merit.
3. 3 Action: If we determine the report is valid, we may, at our sole discretion:
   • Remove or disable access to the allegedly infringing content.
   • Notify the User who posted the content, providing them with a copy of your Notice and information on how to submit a counter-notification.
   • Temporarily or permanently suspend the User's account, particularly for repeat infringers.
4. 4 Counter-Notice: If the User believes the content was removed mistakenly, they may submit a counter-notice. If a valid counter-notice is received, we may reinstate the content within 10-14 business days, unless you inform us that you have filed a court action to restrain the User.

10.1 Data Collection and Use

Our collection and use of personal information is governed by our Privacy Policy. By using our Platform, you agree to:

• Our collection, use, and sharing of your information as described in our Privacy Policy
• The transfer of your information to countries where we operate, which may have different data protection laws
• Receive communications from us about your account and our services

10.2 User Data Responsibilities

When you have access to other Users' information, you must:

• Use personal information only for Platform-related purposes
• Not share, sell, or distribute other Users' information without their explicit consent
• Implement appropriate security measures to protect any User data in your possession
• Delete User data when it is no longer needed for its original purpose
• Comply with all applicable data protection laws, including GDPR for European Users

10.3 Data Security

You must take reasonable steps to protect your account and personal information:

• Use strong, unique passwords for your account
• Enable two-factor authentication if available
• Keep your contact information and security settings up to date
• Notify us immediately if you suspect any unauthorized access to your account

11.1 Account Security

You are responsible for maintaining the security of your account:

• Use a strong, unique password that you don't use for other services
• Keep your password confidential and don't share it with others
• Enable additional security features such as two-factor authentication when available
• Log out of your account when using shared devices
• Notify us immediately at support@KindGive.com if you suspect unauthorized access

11.2 Prohibited Security Activities

You may not engage in activities that compromise Platform security:

• Attempting to probe, scan, or test the vulnerability of any system or network
• Breaching or circumventing any security or authentication measures
• Accessing or searching the Platform by any means other than our publicly supported interfaces
• Interfering with or disrupting the access of any User, host, or network
• Introducing malware, viruses, Trojan horses, worms, logic bombs, or other harmful material

11.3 Reporting Security Vulnerabilities

If you discover a security vulnerability in our Platform:

• Do not exploit the vulnerability or disclose it publicly
• Report it immediately to security@KindGive.com
• Provide sufficient information to allow us to reproduce and fix the issue
• Give us reasonable time to address the vulnerability before sharing information about it

12.1 How to Report

If you encounter content or behavior that violates this Acceptable Use Policy:

• Use the "Report" feature available on Project pages, comments, and messages
• For complex issues, email details to abuse@KindGive.com
• Provide specific information about the violation, including URLs and usernames
• Include any evidence that supports your report

12.2 What to Include in Reports

To help us investigate effectively, please include:

• The specific policy provision you believe has been violated
• The username(s) of those involved
• URLs to the specific content in question
• Description of the violation with dates and times if applicable
• Any supporting evidence such as screenshots

12.3 Good Faith Reporting

When reporting violations:

• Only report content that you genuinely believe violates this Policy
• Do not make false or malicious reports
• Do not coordinate mass reporting campaigns against other Users
• Understand that we may not take action on every report, depending on our investigation

13.1 Investigation Process

When we receive a report or identify potential violations:

• We review the content or behavior in question
• We consider context, intent, and severity when evaluating violations
• We may review account history and previous violations
• We may contact involved parties for additional information
• We make determinations based on available evidence

13.2 Possible Actions

Depending on the nature and severity of the violation, we may:

• Issue a warning and request corrective action
• Remove violating content
• Restrict account privileges
• Suspend account access temporarily
• Permanently terminate accounts
• Withhold or refund payments
• Ban devices or IP addresses
• Take legal action when appropriate
• Report violations to law enforcement or regulatory agencies

13.3 Appeals Process

If you believe we've made an error in enforcing this Policy:

• You may appeal enforcement decisions by contacting appeals@KindGive.com
• Appeals must be submitted within 30 days of the enforcement action
• Include your username, the action being appealed, and reasons for the appeal
• We will review appeals and respond within a reasonable timeframe
• Our decisions on appeals are final

14.1 Modification Rights

We may update this Acceptable Use Policy from time to time:

• We reserve the right to modify this Policy at our discretion
• Changes may reflect new features, legal requirements, or community needs
• We will provide notice of significant changes through email or Platform notifications
• The updated version will be posted on our website with a new effective date

14.2 Notice of Changes

When we make changes to this Policy:

• We will provide at least 30 days' notice for significant changes
• We will highlight the changes for your review
• Continued use of the Platform after changes take effect constitutes acceptance
